Welcome to Cyberraxha. These Terms of Service ("Terms") govern your access to and use of the Cyberraxha mobile application, website, and related services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICE.

1. Acceptance of Terms

By accessing or using Cyberraxha, you agree to:

• Be bound by these Terms of Service
• Comply with our Privacy Policy
• Follow all applicable laws and regulations

If you do not agree to these Terms, you must not use our Service.

2. Description of Service

Cyberraxha provides:

• Security Analysis - AI-powered analysis of messages, URLs, emails, phone numbers, and images for potential scams and threats
• Breach Checking - Email breach database lookups
• Educational Content - Learning modules, simulations, quizzes, and videos about cybersecurity and scam awareness
• News and Updates - Latest cybersecurity news and threat intelligence
• Progress Tracking - Personal learning progress and achievements

3. Eligibility

You must be at least 13 years old (or 16 in the European Union) to use Cyberraxha. By using our Service, you represent and warrant that you meet this age requirement.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account Registration

4.1 Creating an Account

To use Cyberraxha, you must create an account using one of the following methods:

• Email link (passwordless authentication)
• Google OAuth
• Apple Sign-In

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

5. Credits and Payment

5.1 Credit System

Certain features of the Service require credits:

• Security Analysis - Each analysis (message, URL, image, email, phone number) consumes credits
• Credit Packages - Available for purchase through the in-app store
• Non-Refundable - Credits are non-refundable once purchased
• No Expiration - Credits do not expire as long as your account remains active

5.2 Pricing

Current credit packages:

• 15 credits - €2.99
• 60 credits - €11.99
• 120 credits - €23.99

Prices are subject to change. We will notify you of price changes before they take effect.

5.3 Payment Processing

Payments are processed through:

• Stripe - For credit/debit card payments
• Google Play Billing - For Android in-app purchases
• Apple App Store - For iOS in-app purchases

By making a purchase, you agree to the terms of the respective payment processor.

5.4 Refund Policy

Credits are generally non-refundable. However, we may provide refunds at our sole discretion in cases of:

• Billing errors or duplicate charges
• Technical issues preventing service use
• Violation of applicable consumer protection laws

Contact support@cyberraxha.com within 14 days of purchase to request a refund.

6. Acceptable Use

6.1 You MAY:

• Use the Service for personal, educational, or commercial purposes
• Submit content for analysis to assess potential threats
• Share analysis results with others
• Access educational materials and learning modules

6.2 You MAY NOT:

• Submit illegal content - Child sexual abuse material, terrorist content, or other illegal material
• Abuse the Service - Excessive automated requests, attempts to overload systems, or reverse engineering
• Circumvent limitations - Bypassing credit requirements or access controls
• Violate others' rights - Infringing intellectual property, privacy, or other rights
• Resell the Service - Redistributing or reselling access without authorization
• Impersonate others - Pretending to be another person or entity
• Interfere with Service - Introducing malware, viruses, or disruptive code
• Scrape or harvest data - Automated extraction of user data or content

7. Intellectual Property

7.1 Our Content

All content on Cyberraxha, including but not limited to:

• Text, graphics, logos, images, videos
• Software, code, algorithms
• Learning modules, quizzes, simulations
• News articles and educational content

...is owned by or licensed to Cyberraxha and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of content you submit for analysis. However, you grant us a limited, non-exclusive, worldwide license to:

• Process and analyze your submitted content
• Store content for 14 days to improve our services
• Use anonymized, aggregated data for research and service improvement

We do NOT claim ownership of your content and will NOT use it for purposes beyond those stated in our Privacy Policy.

8. Disclaimer of Warranties

Some jurisdictions do not allow exclusion of implied warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Cyberraxha and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your submitted content
• Any actions taken based on analysis results provided by our Service

11. Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Availability of specific features
• Compatibility with all devices or operating systems

We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

12. Third-Party Services

Our Service integrates with third-party services:

• Google Web Risk API - URL threat analysis
• Anthropic Claude AI - Content analysis and threat detection
• OpenAI - Language model-based content analysis and threat detection
• Firebase - Authentication and infrastructure
• Stripe - Payment processing

These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

13. User Support

We offer customer support through:

• In-app chat - Via Crisp support system
• Email - support@cyberraxha.com

Premium support is available at €30 per 30 minutes for priority assistance and consultation.

14. Account Termination

14.1 Termination by You

You may delete your account at any time through the app settings. Upon deletion:

• Your account will be immediately deactivated
• Unused credits will be forfeited (non-refundable)
• Personal data will be deleted in accordance with our Privacy Policy
• Analyzed content will be deleted within 14 days

14.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse the Service or harm other users
• Fail to pay for services
• Pose a security risk

Upon termination by us, unused credits will be forfeited without refund unless termination was due to our breach of these Terms.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms with a new "Last Updated" date
• Sending email notification to your registered address
• Displaying an in-app notification

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. The service is available worldwide.

16.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising from these Terms:

1. Informal Resolution: Contact us at legal@cyberraxha.com to attempt good-faith resolution
2. Mediation: If informal resolution fails, disputes may be submitted to mediation
3. Arbitration: Unresolved disputes shall be settled by binding arbitration in accordance with [ARBITRATION RULES]

16.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive the right to participate in class actions, class arbitrations, or representative actions.

Note: Some jurisdictions do not allow class action waivers. If you reside in such a jurisdiction, this provision may not apply to you.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cyberraxha regarding the Service and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms and our rights without restriction.
